Terms of Service

1. Acceptance of Terms
By accessing or using CardWiki (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.
2. Description of Service
CardWiki is a trading card identity and collection management platform. The Service provides card identification, catalog browsing, collection tracking, community data contributions, and compliant routing to third-party marketplaces and services. CardWiki is not a marketplace, auction house, or pricing service.
3. User Accounts
You must create an account to access authenticated features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 13 years of age to create an account. You agree to provide accurate information and to update it if it changes.
4. Acceptable Use
You agree not to:
- Upload false, misleading, or fraudulent card data
- Attempt to manipulate card identity, verification states, or evidence
- Use automated tools to scrape, harvest, or bulk-extract data from the Service
- Interfere with the Service's operation, security, or other users' access
- Use the Service to facilitate counterfeiting, fraud, or deceptive practices
- Circumvent moderation, trust scoring, or rate-limiting mechanisms
- Impersonate other users, administrators, or CardWiki staff
5. User-Generated Content
By submitting content to CardWiki (including card images, identity data, corrections, evidence, and mining contributions), you grant CardWiki a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and improving the Service. You retain ownership of your original content but acknowledge that identity data you contribute may become part of the shared catalog.
You represent that you have the right to submit any content you upload and that it does not infringe any third party's rights.
6. Intellectual Property
The CardWiki platform, including its software, design, branding, CWID system, and canonical data structures, is the property of CardWiki and is protected by applicable intellectual property laws. Trading card images, names, and trademarks remain the property of their respective owners. CardWiki's use of card data is for identification and reference purposes.
7. Third-Party Links and Services
CardWiki may provide links to third-party marketplaces, grading services, and other external services. These links are provided for convenience and reference only. CardWiki is not responsible for the content, accuracy, or practices of third-party sites. Some links may include affiliate parameters; see our AI & Data Use Policy for details.
8. Disclaimers
The Service is provided “as is” and “as available.” CardWiki makes no warranties, express or implied, regarding the accuracy of card identifications, match confidence scores, estimated values, or any other data provided through the Service. CardWiki is not a professional appraisal or authentication service.
Card identity data is community-contributed and algorithmically processed. Verification states indicate confidence levels, not guarantees. Users should independently verify information important to purchase, sale, or insurance decisions.
9. Limitation of Liability
To the maximum extent permitted by law, CardWiki and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to losses from incorrect card identification, data errors, or reliance on match confidence scores.
10. Account Termination
CardWiki may suspend or terminate your account for violation of these terms, abusive behavior, or at our discretion with reasonable notice. Upon termination, your right to use the Service ceases. You may request export of your collection data before termination takes effect.
11. Dispute Resolution
Informal Resolution
Before filing any formal claim, both parties agree to attempt to resolve disputes informally. You agree to contact us at legal@cardwiki.com with a written description of the dispute and your desired resolution. We will attempt to resolve the dispute within 30 days of receipt. If we cannot reach a resolution within that period, either party may proceed to arbitration as described below.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions about their existence, validity, or termination — that is not resolved informally shall be finally settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Delaware, United States. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
Small Claims Exception
Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies and remains in small claims court.
No Class Actions
All claims must be brought in a party's individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Costs
AAA filing fees shall be allocated in accordance with AAA's Consumer Arbitration Rules. Each party shall bear its own attorneys' fees unless the arbitrator determines the claim was frivolous.
